This Deed of Donation made and executed by:

The GLOBE ASIATIQUE REALITY HOLDINGS CORPORATION, a corporation duly organized and existing under Philippine Law with business address at W-1408, 14th Floor, PSE Center, West Tower, Exchange Road, Oratigas Center, Pasig City, duly represented by its President, MR. DELFIn S. LEE, hereinafter referred to as the DONOR;

The DEPARTMENT OF EDUCATION a government agency with office address at DepEd Complex, Meralco Avenue, Pasig City herein represented by its Secretary, HON. JESLI A. LAPUS, hereinafter referred as a DONEE;

WITNESSETH

That for and in consideration of a desire to contribute a share for a cause of the education of Filipino learners through Adopt-a-School Program, of the Department of Education, the DONOR hereby voluntarily and freely gives, transfer and conveys, by way of donation unto said DONEE, its successors and assigns free and clear of any and all liens and encumbrances and charges of whatsoever  nature all of the rights, interests, and title which said DONOR has over a real property covered by TCT No. 169778, together with the buildings and improvements found therein, identified as DONA ASUNCION SY LEE School Building, a fully furnished and multi-media equipped two-storey school building, located in Barrio Tabun, Municipality of Mabalacat, Province of Pampanga situated on a parcel of land more particularly as follows:

Original Copies of the Transfer Certificate of Title and of the Master Plan are attached hereto and hereby turned over to the DONEE, receipt of which is hereby acknowledged and duly accepted.

All other personal properties as well as its technical descriptions are attached to Annex “A”, and forms part this Deed of Donation

 

Terms and Conditions of Donation;

 

  1. The DONEE hereby agrees to retain the name of the school building and to perpetually maintain its operation and provide funds therefore. Due to the recognized prohibition in naming a school after a living person, the DONEE hereby agrees that only the structural building shall be under the name of the DONA ASUNCION SY LEE.
  2. The DONEE is prohibited from transferring, conveying or assigning the school building or any of the donated movables through sale, donation, and expropriation or through any other deeds of conveyances.
  3. The DONEE shall not have the school building or any of the donated movables to be leased or used for purposes other than for the provision of quality education, under the public school system, to the students of Bacolor and of neighboring towns and provinces and shall ensure that the same together with its interiors, furnishings, playground and equipment shall remain fully functional, operational and available for their intended use.
  4. Any exterior architectural design shall not be altered, modified, defaced in any manner whatsoever,  and any necessary repair due to ordinary wear and tear shall be made only for the purpose of restoring the structure to its original state, form and condition.
  5. The above subject parcel of land shall be used solely and exclusively for the construction of the Church building and no other structures may be constructed thereof any additional structure that the DONEE may intend to construct shall be subject to the consent and approval of Globe Asiatique Property Management Corporation.
  6. The above subject parcel of land shall not be alienated, sold, mortgaged, or it any manner encumbered by the DONEE. Any encumbrance, whether voluntary or through any legal order issued by any competent court, shall be treated as inferior to the intention of the DONOR for which this act has been made and duly declared and annotated in the Registry of Deeds for Angeles City , Province of Pampanga.
  7. Any act violative of the restriction imposed, or the conditions stated in paragraphs: 1 to 5 shall give rise to the right of the DONOR to rescind, at its option, this entire Deed of Donation and revert back the ownership of the above subject parcel of land together with all its improvement to the DONOR, or in case the DONOR’s corporate existence is terminated to Mr. Delfin Lee, or in the event of his demise, this rights passed on to his compulsory heirs.
  8. At option of DONOR, it has right to secure his donation by purchasing a property insurance over the subject improvement. As owner of the insurance policy, the DONOR has exclusive right to name its beneficiary. 

The right of the beneficiary, however, is subject to the immediately preceding paragraph.

All of the foregoing are perpetual limitations and conditions imposed hereto by the DONOR, and no other issues may be raised by any other party to question the act made by the DONOR, or any may claim any exception to the restrictions and conditions imposed hereto.

IN WITNESS WHEREOF, the donor has need to subscribed himself this 19th day of January 2008 while DONEE duly acknowledged and accepted his Deed of Donation on even date.

The DONEE shall not have the school building or any of the donated movables to be leased or used for purposes other than for the provision of quality education,  under the public school system, to the students of Bacolor and of neighboring towns and provinces and shall ensure that the same together with its interiors, furnishings, playground and equipment shall remain fully functional, operational and available for their intended use.

Delfin Lee of GLOBE ASIATIQUE is awarded  damages against PAGIBIG according to the Regional Trial Court of Makati branch 58.

Based on a resolution released by the court, Delfin Lee of Globe Asiatique is awarded right to damages thereby winning against PAGIBIG in a civil case filed by Delfin Lee as its President against PAGIBIG.  Said resolution was filled against PAGIBIG dated Nov 15, 2010. respondents are HDMF or PAGIBIG fund, its incorporators, Emma Linda Faria and Atty Darlene Berberabe.

In a 20 page summary judgment , the regional Trial court of Makati has clearly determined that the unilateral cancellation  of the continuing FCA’s and other related contracts where the reason of the alleged PAGIBIG-Globe Asiatique controversy.   In other words they failed to do their duties or their failure to comply with the contract started all of this.  

PAGIBIG is now ordered to comply faithfully and religiously with its obligations under the said contracts, including but not limited to the release of loan take out proceeds, process the approval of qualified PAGIBIG member loans, automatically off set remaining balances against the retention money, escrow money, funding commitment fees, loan take out proceeds and other receivables of GARHC which are still in control and possession of HDMF and apologize to the public. In reality Delfin Lee is a Pioneer. He was the first to build township projects for the benefit of the masses, and yes the poor. The poor who cannot afford their own homes. Globe Asiatique created a community complete with free education, free books, uniform and shoes. Their township projects such as Xevera Bacolor and Xevera Mabalacat has its own Municipality, school, commercial areas, complete with amenities and of course a church. He believes in the spiritual relationship of the Filipino and thereby making sure that all of his projects has a church. In fact  165 million worth of churches complete with furniture, fixture and air-conditioners was donated to Archbishop Paciano Aniceto.

The truth is, Delfin Lee was the first businessman who ever dared to help the poor.. Not only that he wanted to give them the lifestyle of a privileged Filipino he also wanted them to have affordable homes  with  world class amenities right at their doorsteps such as a club house with swimming pools, basketball court, badminton court, Theme parks and eco parks.

What is the basis for the arrest of Delfin Lee?

According to the PNP, his arrest was based on the 2nd Alias Writ of Warrant of Arrest issued by the Regional Trial Court (RTC) dated August of 2013;

Is the warrant of arrest used by the PNP to arrest Delfin Lee still a valid and subsisting warrant of arrest?

NO! Why? Because it has already been RECALLED, QUASHED, and LIFTED by the Court of Appeals in a Decision dated 7 November 2013.

Was the RECALL, QUASHAL and LIFTING of the warrant of arrest against Delfin Lee immediately executory?

YES! Because it is clearly provided in the Decision of the Court of Appeals that, and to quote:

“ x x x all government agencies tasked in the enforcement of the said warrant of arrest including but not limited to PNP, NBI, and the Bureau of Immigration are IMMEDIATELY ENJOINED from implementing the same.”

Nangako rin si Lee na lilinawin niya sa publiko ang nasa Hkod ng umano'y housing scam na naging dahilan para arestuhin siya at ikulong sa provincial jail ng Pampanga. SA isang pahayag na ipinalabas sa pamamagitan ng abogado niyang si Willy Rivera, iginiit ni Lee na isang 'panlilinlang at malaking biro' ang umanoV multibillion housing fund scam. "Para sa hustisya at patas na labanan, isinasailalim ko ang sarili ko sa imbestigasyon ng Senado para ibunyagsa publiko ang totoong sirkumstansiya sa kaso at sa patuloy na alegasyon laban sa aking integridad at Gawain sa negosyo," sabi pa sa pahayag. Iginiit ni Lee na inosente siya sa mga kasong isinampa laban sa kanya. Mapanlinlang umano ang umano'y manipulasyonat sabwatan na naging disbentahe sa mgahomebuyer.Isasagawa ng Senate Committee on Urban Planning,Housing and Resettlement na pinangunguluhan ni Sen. JV Ejercito ang unang pagdinig sa umano'y housing scam. Asiatique, denied that he attempted to flee the country amid his P6.6-billion syndicated estafa case.

Delfin Lee's legal counsel said his client needs to be scheduled for a medical checkup after Lee suffered high blood pressure shortly after being arrested last Thursday.

“There was a physician yesterday saying delikado po iyon [condition niya],” Atty. Willie Rivera said in a report from GMA's “24-Oras” program on Saturday.

Rivera said they plan to file an urgent motion for medical checkup at the Court of Appeals.

He added that Lee was feeling numbness in his arms and was having a difficult time in custody at the National Bureau of Investigation headquarters in Pampanga.

But Lee was able to eat and sleep properly yesterday, the report said.

Meanwhile, an agent on duty confirmed that Lee was suffering from high blood pressure after being checked up by the NBI doctor after the arrest.

“Blood pressure lang po [ang findings]. Medyo tumaas daw po,” the agent said.

Some relatives and friends also went to visit him on Saturday but were denied entry in the detention facility since visiting hours have already passed, the report said.

The lawyer of Globe Asiatique founder Delfin Lee questioned the validity of the arrest warrant issued against his client, who was earlier arrested at a hotel in Manila over a P6.6-billion syndicated estafa case.
 
According to a report on GMA News TV's Unang Balita on Friday, Lee's legal counsel, lawyer Gilbert Repizo, insisted that the warrant against his client has been quashed.
 
"We are showing to the public na quashed ang warrant of arrest, though may different view sila. Nag-file ang gobyerno ng petition for review," he said.
 
Justice Secretary Leila de Lima on Friday, however, said the arrest warrant against Lee still stands. 
 
Of the arrest, de Lima said: "We welcome such development, especially so that our position that the arrest warrant against Delfin Lee still subsists in light of our pending petition before the Supreme Court questioning the CA's (Court of Appeals) decision quashing said warrant."
 
Repizo also stressed that Lee was only invited to the Philippine National Police's headquarters in Camp Crame for clarification regarding the status of his warrant. However he was made to undergo police booking, including taking his mugshot and fingerprints, the report said.
 
For his part, PNP's Criminal Investigation and Detection Group National Capital Region Chief Sr. Supt. Jigs Coronel said that while the CA quashed the warrant, the Home Development Mutual Fund, or the Pag-IBIG Fund, asked the Supreme Court to reverse that decision.
 
"I understand that Mr. Delfin Lee filed an appropriate action at the Court of Appeals 15th Special Division, which issued an order directing the RTC San Fernando, Pampanga to lift the warrant of arrest," he said. "However, Pag-IBIG Fund filed also a petition before the Supreme Court."
 
Police noted that the CA said in February that it recognizes the jurisdiction of the SC to decide on the matter of the warrant against Lee.
 
On Friday, police brought Lee to the San Fernando, Pampanga Regional Trial Court from Camp Crame, where he was earlier brought after his arrest Thursday evening, as they returned the businessman's arrest warrant.
 
The television report said the PNP decided to bring Lee to the San Fernando court since his camp had questioned the validity of his arrest.
 
Lee, who is accused of using fake documents to secure billions in pesos' worth of loans for "ghost" borrowers, had been at large for months, and was arrested by PNP Task Force Tugis around 7 p.m. outside Hyatt Hotel in Malate, Manila, Ivan Mayrina reported on GMA News' “State of the Nation.”
