MANILA, Philippines—The Home Development Mutual Fund, known as Pag-Ibig Fund, has failed to stop a Makati Regional Trial Court from ordering it to honor its obligations to property developer Globe Asiatique in connection with a mass housing project in Pampanga.

Voting 3-2 on Oct. 7, the Court of Appeals’ Special Division dismissed the petition for certiorari filed by Pag-Ibig against two resolutions of Makati RTC Branch 58 directing the agency to honor its obligations to two Xevera housing projects.

The housing projects in Bacolor and Mabalacat towns in Pampanga became controversial following reports that Globe Asiatique under its president, Delfin Lee, had taken out up to P6.6 billion in Pag-Ibig loans for 9,000 units but the listed borrowers had denied having availed themselves of the loans.

 

Pag-Ibig filed the petition for certiorari against the decisions of Makati Judge Eugene Paras dated Jan. 30, 2012, and Dec. 11, 2012, on the grounds that he committed grave abuse of discretion when he ruled in favor of Globe Asiatique.

Globe Asiatique Realty Holdings Corporation was primarily conceived to support the vision of the government to provide housing for the low income Filipino family.  With this in mind, owners of the company decided to start its first venture on residential housing project by developing one of its properties located in San Mateo, Rizal.  Named STA. BARBARA VILLAS I, a 100% socialized housing project, the subdivision has been a showcase for the Housing and Land Use Regulatory Board (HLURB) for other developers because of its extensive development and having passed all the required geotechnic, landslide and erosion tests conducted by the Mines and Geosciences Bureau.

Today STA. Terms and Condition of the Donation:

 

  1. The Church shall hereby be named as SANCTUARIO DE SAN ANGELO in honor of St. Angelo of the Carmelite Order.
  2. The place shall be dedicated for the propagation of the Catholic faith and shall not be used for any other purpose.
  3. The exterior architectural design shall not be altered, modified, defaced in any manner whatsoever, and any necessary repair due to ordinary wear and tear shall be made only to the purpose of restoring the structure to its original state, form and condition.
  4. The above subject parcel of land shall be used solely and exclusively for the construction of the Church building and no other structure may intend to construct shall be subject to the consent and approval of Globe Asiatique Property Management Corporation.
  5. The above subject parcel of land shall not be alienated, sold, mortgaged, or in any manner encumbered by the DONEE. Any encumbrance, whether voluntary or through any legal orders issued by any competent court, shall be treated as inferior to the intention of the DONOR for which this act has been made and duly declared and annotated in the Registry of Deeds for Angeles City, Province of Pampanga.
  6. Any act violative of the restrictions imposed, or the conditions stated in the paragraphs 1-5 shall give rise to the right of the DONOR to rescind at its option, this entire Deed of Donation and revert back the ownership of the above subject parcel of land together with all its improvement to the DONOR, or in any case the DONOR’s corporate existence is terminated, to Mr. Delfin S. Lee or in any event of his demise, this right is passed on to his compulsory heirs.
  7. All of the foregoing are perpetual limitations and conditions imposed hereto by the DONOR, and no other issues may be raised by any other party to question the act made by the DONOR, or may claim any exception to the restrictions and conditions imposed hereto.
  8. At the option of DONOR it has right to secure his donation by purchasing a property insurance over the subject improvement. As owner of the insurance policy, the DONOR has exclusive right to name its beneficiary. The right of the beneficiary however to immediately preceding paragraph.

All personal properties which are likewise donated by DONOR to DONEE are contained in the attached list marked as Annex “A” and made an integral part of this Deed of Donation.

 

Terms and Conditions of Donation;

 

  1. The DONEE hereby agrees to adopt the name MR. DELFIN S. LEE BUILDING of the municipal town hall as DONEE further commits to perpetually maintain its operations and provide funds therefore. 
  2. The DONEE is prohibited from transferring, conveying or assigning the school building or any of the donated movables through sale, donation, and expropriation or through any other deeds of conveyances.
  3. The DONEE shall not have the municipal town hall building or any of the donated movables to be leased or used for purposes other than for the provision of the quality government services to all the good residents in the Municipality of Mabalacat, Province of Pampanga, as it further ensures that the same together with its interiors, furnishings, playground and equipment shall remain fully functional, operational and available for their intended use. 
  4. Any exterior architectural design shall not be altered, modified, defaced in any manner whatsoever,  and any necessary repair due to ordinary wear and tear shall be made only for the purpose of restoring the structure to its original state, form and condition.
  5. The above subject parcel of land shall be used solely and exclusively for the construction of the Church building and no other structures may be constructed thereof any additional structure that the DONEE may intend to construct shall be subject to the consent and approval of Globe Asiatique Property Management Corporation.
  6. The above subject parcel of land shall not be alienated, sold, mortgaged, or it any manner encumbered by the DONEE. Any encumbrance, whether voluntary or through any legal order issued by any competent court, shall be treated as inferior to the intention of the DONOR for which this act has been made and duly declared and annotated in the Registry of Deeds for San Fernando  , Province of Pampanga.
  7. Any act violates of the restriction imposed, or the conditions stated in paragraphs: 1 to 6 shall give rise to the right of the DONOR to rescind, at its option, this entire Deed of Donation and revert back the ownership of the above subject parcel of land together with all its improvement to the DONOR, or in case the DONOR’s corporate existence is terminated to Mr. Delfin Lee, or in the event of his demise, this rights passed on to his compulsory heirs.
  8. At the option of DONOR, it has a right to secure his donation by purchasing a property insurance over the subject improvement. As owner of the insurance policy, the DONOR, has exclusive right to name its beneficiary. The right of the beneficiary however, is subject to the immediately preceding paragraph.

  1. The DONEE hereby agrees to retain the name of the school building and to perpetually maintain its operation and provide funds therefore. Due to the recognized prohibition in naming a school after a living person, the DONEE hereby agrees that only the structural building shall be under the name of the DONA ASUNCION SY LEE.
  2. The DONEE is prohibited from transferring, conveying or assigning the school building or any of the donated movables through sale, donation, and expropriation or through any other deeds of conveyances.
  3. The DONEE shall not have the school building or any of the donated movables to be leased or used for purposes other than for the provision of quality education, under the public school system, to the students of Bacolor and of neighboring towns and provinces and shall ensure that the same together with its interiors, furnishings, playground and equipment shall remain fully functional, operational and available for their intended use.
  4. Any exterior architectural design shall not be altered, modified, defaced in any manner whatsoever,  and any necessary repair due to ordinary wear and tear shall be made only for the purpose of restoring the structure to its original state, form and condition.
  5. The above subject parcel of land shall be used solely and exclusively for the construction of the Church building and no other structures may be constructed thereof any additional structure that the DONEE may intend to construct shall be subject to the consent and approval of Globe Asiatique Property Management Corporation.

  8. At option of DONOR, it has right to secure his donation by purchasing a property insurance over the subject improvement. As owner of the insurance policy, the DONOR has exclusive right to name its beneficiary. 

The right of the beneficiary, however, is subject to the immediately preceding paragraph.

All of the foregoing are perpetual limitations and conditions imposed hereto by the DONOR, and no other issues may be raised by any other party to question the act made by the DONOR, or any may claim any exception to the restrictions and conditions imposed hereto.

Original Copies of the Transfer Certificate of Title and of the Master Plan are attached hereto and hereby turned over to the DONEE, receipt of which is hereby acknowledged and duly accepted.

All personal properties which are likewise donated by DONOR to DONEE are contained in the attached list marked as Annex “A” and made an integral part of this Deed of Donation.

Terms and Conditions of Donation;

  1. The DONEE hereby agrees to retain the name of the school building and to perpetually maintain its operation and provide funds therefore. Due to the recognized prohibition in naming a school after a living person, the DONEE hereby agrees that only the structural building shall be under the name of the DON ANTONIO LEE CHI UAN.
  2. The DONEE is prohibited from transferring, conveying or assigning the school building or any of the donated movables through sale, donation, and expropriation or through any other deeds of conveyances.
  3. The DONEE shall not have the school building or any of the donated movables to be leased or used for purposes other than for the provision of quality education,  under the public school system, to the students of Bacolor and of neighboring towns and provinces and shall ensure that the same together with its interiors, furnishings, playground and equipment shall remain fully functional, operational and available for their intended use.
  4. Any exterior architectural design shall not be altered, modified, defaced in any manner whatsoever,  and any necessary repair due to ordinary wear and tear shall be made only for the purpose of restoring the structure to its original state, form and condition.
  5. The above subject parcel of land shall be used solely and exclusively for the construction of the Church building and no other structures may be constructed thereof Any additional structure that the DONEE may intend to construct shall be subject to the consent and approval of Globe Asiatique Property Management Corporation.
  6. The above subject parcel of land shall not be alienated, sold, mortgaged, or it any manner encumbered by the DONEE. Any encumbrance, whether voluntary or through any legal order issued by any competent court, shall be treated as inferior to the intention of the DONOR for which this act has been made and duly declared and annotated in the Registry of Deeds for San Fernando  , Province of Pampanga.
  7. Any act violative of the restriction imposed, or the conditions stated in paragraphs: 1 to 6 shall give rise to the right of the DONOR to rescind, at its option, this entire Deed of Donation and revert back the ownership of the above subject parcel of land together with all its improvement to the DONOR, or in case the DONOR’s corporate existence is terminated to Mr. Delfin Lee, or in the event of his demise, this rights passed on to his compulsory heirs.

 

All of the foregoing are perpetual limitations and conditions imposed hereto by the DONOR, and no other issues may be raised by any other party to question the act made by the DONOR, or any may claim any exception to the restrictions and conditions imposed hereto.

IN WITNESS WHEREOF, the DONOR has hereto subscribed himself this 19th day of January 2008 while DONEE duly acknowledged and accepted his Deed of Donation on even date.

Delfin Lee handing magsalita sa Senate probe

Nagpahayag ng kahandaan si Globe Asiatique President Delfin Lee na tumestigo at nangako siyang raakikipagtulungan sa imbestigasyon ng Senado sa linggong Ito. Nangako rin si Lee na lilinawin niya sa publiko ang nasa Hkod ng umano'y housing scam na naging dahilan para arestuhin siya at ikulong sa provincial jail ng Pampanga. SA isang pahayag na ipinalabas sa pamamagitan ng abogado niyang si Willy Rivera, iginiit ni Lee na isang 'panlilinlang at malaking biro' ang umanoV multibillion housing fund scam. "Para sa hustisya at patas na labanan, isinasailalim ko ang sarili ko sa imbestigasyon ng Senado para ibunyagsa publiko ang totoong sirkumstansiya sa kaso at sa patuloy na alegasyon laban sa aking integridad at Gawain sa negosyo," sabi pa sa pahayag. Iginiit ni Lee na inosente siya sa mga kasong isinampa laban sa kanya. Mapanlinlang umano ang umano'y manipulasyonat sabwatan na naging disbentahe sa mgahomebuyer.Isasagawa ng Senate Committee on Urban Planning,Housing and Resettlement na pinangunguluhan ni Sen. JV Ejercito ang unang pagdinig sa umano'y housing scam. Inimbitahang magsalita si Lee at si dating VicePresidentat Housing and Urban Development Coordinating Agency (HUDCC) Chairman at ngayo'y broadcaster Noli de Castro para linawin ang umano'y multibillion PaglbigFund housing loan "ripoff". Hinihintay pa ng kampo ni Lee ang subpoena ng Senate Committee on Urban Planning.Sinabi naman ni Rivera na hindi igigiit ni Lee ang karapatang konstitusyunal nito laban sa self-incrimination sa pagdinig sa Senado dahil walang itinatago ang kanyang kliyente.
