Globe Asiatique Realty Holdings Corporation was primarily conceived to support the vision of the government to provide housing for the low income Filipino family.  With this in mind, owners of the company decided to start its first venture on residential housing project by developing one of its properties located in San Mateo, Rizal.  Named STA. BARBARA VILLAS I, a 100% socialized housing project, the subdivision has been a showcase for the Housing and Land Use Regulatory Board (HLURB) for other developers because of its extensive development and having passed all the required geotechnic, landslide and erosion tests conducted by the Mines and Geosciences Bureau.

Today STA. BARBARA VILLAS I with a land area of 80 hectares stands proud and tranquil a top the hills of Barangay Silangan, San Mateo, Rizal, unaffected by natural calamities, its residents composing of employees and their families from the government and private sector, enlisted personnel from the AFP and overseas contract workers as well, each of them enjoying the fruit of their toils and fulfillment of a dream --- a house they can call their own.

As the demand for housing increases, the company continued to support the thrust of the government by developing another 14 hectare property also located at Barangay Silangan, San Mateo, Rizal, 3 kilometers away from the STA BARBARA VILLAS I with the same name. Type of development is a mixed low cost and socialized development aimed to cater the need for housing of the employees of the Office of the Ombudsman and Sandiganbayan. Funding of this project was also approved by PAG-IBIG subject of a MEMORANDUM OF AGREEMENT between the company, PAG-IBIG and the Office of the Ombudsman.

On August 4, 1995, a sister company which operates with the same line of business category was established. Mr. Delfin S. Lee, President of Globe Asiatique Realty Holdings Corporation together with his Malaysian business associates ventured again in the real estate industry, thus FILMAL REALTY CORPORATION was established.

Today, ST. MONIQUE VALAIS located at Barangay Pantok, Binangonan, Rizal is a byword among individuals in the metropolis who dream of owning a house and lot in the said subdivision because of the finesse and cultured type of development applied to the subdivision.

The Court of Appeals Manila special 15th division has issued a recall for the warranty of arrest issued against Delfin Lee of Globe Asiatique and his co-accused. The said warrant of arrest, which is now null and void,  was issued at the Regional Trial court of Pampanga Branch 42 by presiding judge Ma. Amifaith S. Fider-Reyes dated May 22, 2012 in Criminal Case No. 18480. In a 29 page decision ordered by Associate Justice Franchito N. Diamante, the court rules that the warrant of arrest issued against Delfin Lee is quashed, recalled and lifted. Judge Amifaith Reyes is directed to cease and desist from further proceeding with criminal case no 18480 insofar as Delfin Lee of Globe Asiatique is concerned. 

The exact order or ruling of the court is as follows: 

As clearly stated, Delfin Lee of Globe Asiatique is a free man. It is also clear that the court of appeals supersedes any ruling ordered by the regional trial court of Pampanga or any regional trial court nationwide for that matter, since it is the second highest judicial court, right after the Supreme Court.

Additionally, the court of appeals has ordered or instructed all government agencies to implement the said decision. Such government agencies are not limited to the Philippine National police and the national bureau of investigation. Globe Asiatique has original copies of the signed certifications issued by the enforcing agencies that they will respect and follow the courts’ decision.

All of these begs the question why is Delfin Lee in prison? Is Delfin Lee a victim ? is he being held illegally?

We do believe that the facts presented above is not only compelling but is screaming for attention.

Delfin Lee of Globe Asiatique wins against Pag-ibig. Alleged fake loans and fictitious buyer-borrowers is not TRUE according to Makati RTC Branch 58

The alleged fake loans and fictitious buyer-borrowers of Globeasiatique owned by Delfin Lee is not TRUE according to Makati RTC Branch 58. This was based on its decision or resolution dated Jan 30, 2013 under civil case no. 10-1120 Regional Trial Court of Makati Branch 58, Globe Asiatique Realty Holdings Corporation vs HDMF (HDMF) Home Development Mutual fund. 

According to the Makati RTC Branch 58 alleged spurious and fictitious buyer-borrowers are inconsequential, immaterial and irrelevant since it is PAGIBIG who approved their respective PAG-IBIG membership, approved their loan applications, and supposedly post validated their eligibility for loans.

 " alleged spurious and fictitious buyer-borrowers become inconsequential, immaterial and irrelevant as it is the one which approved their PAG-IBIG membership, approved their loan applications, and supposedly post validated their eligibility for loans."

In addition the court has strongly resolved that the function, process or duty of loan application approval was not given to Globe Asiatique. This can be found on the MOA or Memorandum of Agreement duly signed by both parties.

"Globe Asiatique, on the other hand, cannot be said to have breached any of the warranties provided in the FCAs because these warranties are now inexistent as per the provisions of the MOA because these warranties are premised on the supposed power of Globe Asiatique to approve the loan applications of the PAG-IBIG FUND buyer-borrowers, a power which has already been removed by the MOA. "

We believe that this decision, among others, is another hindrance of PAGIBIG.  This is another proof that Delfin Lee and Globe Asiatique has never defrauded anyone. Based on evidence, any Filipino will agree that Delfin Lee of Globe Asiatique is merely performing its duties and obligations as stated on its contract. A legal contract that is notarized and has been made a public document as an effect of doing so.

Delfin Lee of GLOBE ASIATIQUE is awarded  damages against PAGIBIG according to the Regional Trial Court of Makati branch 58.

Based on a resolution released by the court, Delfin Lee of Globe Asiatique is awarded right to damages thereby winning against PAGIBIG in a civil case filed by Delfin Lee as its President against PAGIBIG.  Said resolution was filled against PAGIBIG dated Nov 15, 2010. respondents are HDMF or PAGIBIG fund, its incorporators, Emma Linda Faria and Atty Darlene Berberabe.

In a 20 page summary judgment , the regional Trial court of Makati has clearly determined that the unilateral cancellation  of the continuing FCA’s and other related contracts where the reason of the alleged PAGIBIG-Globe Asiatique controversy.   In other words they failed to do their duties or their failure to comply with the contract started all of this.  

PAGIBIG is now ordered to comply faithfully and religiously with its obligations under the said contracts, including but not limited to the release of loan take out proceeds, process the approval of qualified PAGIBIG member loans, automatically off set remaining balances against the retention money, escrow money, funding commitment fees, loan take out proceeds and other receivables of GARHC which are still in control and possession of HDMF and apologize to the public. In reality Delfin Lee is a Pioneer. He was the first to build township projects for the benefit of the masses, and yes the poor. The poor who cannot afford their own homes. Their children who cannot afford to go to school, to buy books, uniforms and even a decent pair of shoes. Globe Asiatique created a community complete with free education, free books, uniform and shoes. Their township projects such as Xevera Bacolor and Xevera Mabalacat has its own Municipality, school, commercial areas, complete with amenities and of course a church. He believes in the spiritual relationship of the Filipino and thereby making sure that all of his projects has a church. In fact  165 million worth of churches complete with furniture, fixture and air-conditioners was donated to Archbishop Paciano Aniceto.

The truth is, Delfin Lee was the first businessman who ever dared to help the poor.. Not only that he wanted to give them the lifestyle of a privileged Filipino he also wanted them to have affordable homes  with  world class amenities right at their doorsteps such as a club house with swimming pools, basketball court, badminton court, Theme parks and eco parks.

Terms and Condition of the Donation:

 

  1. The Church shall hereby be named as SANCTUARIO DE SAN ANGELO in honor of St. Angelo of the Carmelite Order.
  2. The place shall be dedicated for the propagation of the Catholic faith and shall not be used for any other purpose.
  3. The exterior architectural design shall not be altered, modified, defaced in any manner whatsoever, and any necessary repair due to ordinary wear and tear shall be made only to the purpose of restoring the structure to its original state, form and condition.
  4. The above subject parcel of land shall be used solely and exclusively for the construction of the Church building and no other structure may intend to construct shall be subject to the consent and approval of Globe Asiatique Property Management Corporation.
  5. The above subject parcel of land shall not be alienated, sold, mortgaged, or in any manner encumbered by the DONEE. Any encumbrance, whether voluntary or through any legal orders issued by any competent court, shall be treated as inferior to the intention of the DONOR for which this act has been made and duly declared and annotated in the Registry of Deeds for Angeles City, Province of Pampanga.
  6. Any act violative of the restrictions imposed, or the conditions stated in the paragraphs 1-5 shall give rise to the right of the DONOR to rescind at its option, this entire Deed of Donation and revert back the ownership of the above subject parcel of land together with all its improvement to the DONOR, or in any case the DONOR’s corporate existence is terminated, to Mr. Delfin S. Lee or in any event of his demise, this right is passed on to his compulsory heirs.
  7. All of the foregoing are perpetual limitations and conditions imposed hereto by the DONOR, and no other issues may be raised by any other party to question the act made by the DONOR, or may claim any exception to the restrictions and conditions imposed hereto.
  8. At the option of DONOR it has right to secure his donation by purchasing a property insurance over the subject improvement. As owner of the insurance policy, the DONOR has exclusive right to name its beneficiary. The right of the beneficiary however to immediately preceding paragraph.

Any act violative of the restriction imposed, or the conditions stated in paragraphs:1 to 5 shall give rise to the right of the DONOR to rescind, at its option, this entire Deed of Donation and revert back the ownership of the above subject parcel of land together with all its improvement to the DONOR , or in case the DONOR’s corporate existence is terminated to Mr. Delfin Lee, or in the event of his demise, this rights passed on to his compulsory heirs.

7. All of the foregoing are perpetual limitations and conditions imposed hereto by the DONOR and no other issues may be raised by any other party to question the right made by the DONOR, or may claim any exception to the restrictions and conditions imposed hereto.

The GLOBE ASIATIQUE REALITY HOLDINGS CORPORATION, a corporation duly organized and existing under Philippine Law with business address at W-1408 14th Floor, PSE Center, West Tower, Exchange Road, Ortigas Center, Pasig City, duly represented by its President, MR. DELFIN S. LEE, hereinafter referred to as the DONOR;

The MUNICIPAL GOVERNMENT OF MABALACAT, PAMPANGA, a government entity with address at Municipal Building, Mabalacat, Pampanaga, herein represented by its Mayor, HON. MARINO P. MORALES, hereinafter referred to as the DONEE;

WITNESSETH

That for and in consideration of a desire to contribute a share for god governance in the municipality of Mabalacat, Province of Pampanga through a well-equipped and fully functional facility, the DONOR has freely and voluntarily given, transferred and conveyed by way of donation to the DONEE, its successors and assigns free and clear of any and all liens and encumbrances whatsoever all its rights, interests and title thereon, the Municipal Town Hall Annex, a fully furnished and equipped twp-storey building, located in Brgy.  Tabun, Mabalacat situated on a parcel of land more particularly described as follows:

Original Copies of the Transfer Certificate of Title and of the Master Plan are attached hereto and hereby turned over to the DONEE, receipt of which is hereby acknowledged and duly accepted.

All personal properties which are likewise donated by DONOR to DONEE are contained in the attached list marked as Annex “A” and made an integral part of this Deed of Donation.

 

Terms and Conditions of Donation;

 

  1. The DONEE hereby agrees to adopt the name MR. DELFIN S. LEE BUILDING of the municipal town hall as DONEE further commits to perpetually maintain its operations and provide funds therefore. 
  2. The DONEE is prohibited from transferring, conveying or assigning the school building or any of the donated movables through sale, donation, and expropriation or through any other deeds of conveyances.
  3. The DONEE shall not have the municipal town hall building or any of the donated movables to be leased or used for purposes other than for the provision of the quality government services to all the good residents in the Municipality of Mabalacat, Province of Pampanga, as it further ensures that the same together with its interiors, furnishings, playground and equipment shall remain fully functional, operational and available for their intended use. 
  4. Any exterior architectural design shall not be altered, modified, defaced in any manner whatsoever,  and any necessary repair due to ordinary wear and tear shall be made only for the purpose of restoring the structure to its original state, form and condition.
  5. The above subject parcel of land shall be used solely and exclusively for the construction of the Church building and no other structures may be constructed thereof any additional structure that the DONEE may intend to construct shall be subject to the consent and approval of Globe Asiatique Property Management Corporation.
  6. The above subject parcel of land shall not be alienated, sold, mortgaged, or it any manner encumbered by the DONEE. Any encumbrance, whether voluntary or through any legal order issued by any competent court, shall be treated as inferior to the intention of the DONOR for which this act has been made and duly declared and annotated in the Registry of Deeds for San Fernando  , Province of Pampanga.
  7. Any act violates of the restriction imposed, or the conditions stated in paragraphs: 1 to 6 shall give rise to the right of the DONOR to rescind, at its option, this entire Deed of Donation and revert back the ownership of the above subject parcel of land together with all its improvement to the DONOR, or in case the DONOR’s corporate existence is terminated to Mr. Delfin Lee, or in the event of his demise, this rights passed on to his compulsory heirs.
  8. At the option of DONOR, it has a right to secure his donation by purchasing a property insurance over the subject improvement. As owner of the insurance policy, the DONOR, has exclusive right to name its beneficiary. The right of the beneficiary however, is subject to the immediately preceding paragraph.
