Delfin Lee filed a case against PAGIBIG to force them to release all TCTs of fully paid buyer / borrowers.
Also forcing them to do the following: 
3. The unilateral cancellation by defendant HDMF of the continuing FCAs specifically the latest FCAs of December 15, 2009, January 5 and March 17, 2010 and CSA dated 10 February 2009, is hereby SET ASIDE;
4. Defendants are ordered to automatically off-set the balance of those listed in Annex “B” of the Motion for Summary Judgment against the retention money, escrow money, funding commitment fees, loan take-out which are still in the control and possession of defendant HDMF;
5. Defendants are ordered to accept the replacement-buyers listed in Annex “F” of the Motion for Summary Judgment, which list is unopposed by defendants, without interest or penalty from the time of defendant HDMF’s cancellation of the Collection Servicing Agreement (CSA) resulting to the refusal to accept the same up to the time that these replacement buyers are actually accepted by defendant HDMF;
6. Defendants are ordered to release the corresponding Transfer Certificate of Titles [s] (TCT’s) of those accounts which are fully paid or subjected to automatic off-setting starting from the list in Annex “E” of the Motion for Summary Judgment and thereafter from those listed in Annex “F” thereof and cause the corresponding cancellation of the annotations in the titles thereof.

Ito ang desisyon ng korte na naguutos sa pagibig na magbayad ng danyos at ibigay na sa mga fully paid buyers/borrowers ang kanilang titulo, at hindi lang iyon, inuutusan sin sila ng korte na gawin ang mga sumusunod

My ruling na po ang Court of appeals na walang kasalanan ang Globe Asiatique. Ang may sala ay ang PAGIBIG dahil sa unilateral cancellation nila ng mga kontrata at kasunduan.

Estafa vs Globe Asiatique hinarang ng Pasig RTC

NAGPALABAS ng writ of preliminary injunction ang Pasig RTC para pigilan ang Department of Justice na pagsasampa ng kasong estafa kay Delfin Lee, presidente ng Globe Asiatique.

Kanina ay inilabas ng Pasig City Regional Trial Court (RTC) Branch 167 ang writ of preliminary injunction para pigilan ang DOJ sa pagsasampa ng kasong estafa laban sa Globe Asiatique president makaraan ang resolusyon sa civil case na isinampa sa kanya ng Home Development Mutual Fund (HDMF) sa Makati RTC Branch 58.

Ang katulad na preliminary injunction ay pumipigil din sa DOJ sa pagpapatuloy ng preliminary investigation sa isa pang estafa case laban kay Lee.

Inilabas ni Pasig RTC Judge Rolando G. Mislang ang injunction nang panigan ang argumento ni Lee na ang kasong estafa at civil case ay magkatulad at kailangan munang may maresolbahan muna bago maipagpatuloy ang imbestigasyon sa kasong estafa.

Sa civil case na isampa sa Makati court noong Nobyembre 2010, hiniling ng Globe Asiatique sa HDMF o Pag-Ibig Fund na irespeto ang kanilang nauna nang napagkasunduan — ang pagtanggap ng kapalit ng mga kostumer ng GA at paglalabas sa naka-pending na loan take-outs ng kompanya sa Pag-Ibig.

Dinadag pa ni Mislang sa kanyang utos na ang pagkakaroon at kawalan ng “element of damage” sa resolusyon ay malalaman lamang sa civil case na hiwalay na isinampa laban kay Lee.

“If the Makati RTC resolves to compel HDMF to accept the payments tendered by GA pursuant to contracts between them, the element of damage will be negated and will necessarily result in dismissal of the estafa case.”

At ang nasabing ruling umano ng Makati court ay lubos na makaaapekto sa iba pa bang criminal cases sa lungsod.

“The issues in the civil case are determinative not only of the guilt or innocence of petitioner but also whether the criminal cases will have legs to stand on. Pending resolution of this prejudicial question, the proceedings for estafa cases should be suspended.”

Sa petisyon ni Lee, sinabi nito na sa civil case na isinampa sa kanya, ang damage na ipinangangarali ng HDMF ay self-inflicted dahil sa sila mismo ang tumangging makipag-ayos sa GA na handa namang i-update ang kanilang pananagutan.

DELFIN LEE TO SEEK RECONSIDERATION OF LATEST SC RULING

 Reacting to the recent denial of the Supreme Court of his latest motion to for oral argument on his pending case with the SC, detained real estate developer Delfin Lee said that his counsel will immediately file a motion for consideration “so that the consolidated cases will be decided on the merits.”

In a statement issued through his counsel Lawyer Willy Rivera, the embattled property developerearlier filed an urgent motion for oral argument with the SC in all the “consolidated appeals” filed before it by the Home Development Mutual Fund (HDMF) which consist of at least nine petitions for review.

The SC rejected him and his lawyer’s plea for oral arguments in a resolution issued recently.

“We only would like to show the magistrates of the Supreme Court and Filipino people as well,that contrary to HDMF’s claims, we have not defrauded the government and the PAG-IBIG Fund a single centavo.”

Lee lamented that notwithstanding his 100% winning streak before various courts of law, he is now languishing in jail.

“It’s about time that our Supreme Court steps in into this issue to bring back respect for law and order by our police and government officials, for the orderly administration of justice.” Lee added.

The embattled housing developer insists that the Php6.6 Billion being flaunted by HDMF in the media is not a loan of Globe Asiatique from HDMF. 

Lee earlier filed an urgent motion for oral argument with the SC for the 5 cases appealed by HDMF and DoJ.

Reacting further to the denial of the Supreme Court of his latest motion to SC, Lee cited that Pag Ibig Fund together with the Department of Justice “lost all the cases” against him and his company, Globe Asiatique Realty Holding Corp.

“In all the nine appeals filed by HDMF and DOJ now pending before the SC, at least 27 justices of the Court of Appeals and 2 Regional Trial Court judges sided with us rendering judgments ranging from—a declaration that HDMF breached its contracts with Globe Asiatique that resulted to all these fiasco.

“From a quashal of the Information for syndicated estafa, recall and lifting of the warrants of arrest against me and my co-accused Christina Sagun and Atty. Alex Alvarez, and the dismissal of the syndicated estafa case against all of us for lack of probable cause for the crime of syndicated estafa”, we still remain languishing in jail

Lee lamented that notwithstanding his 100% winning streak before various courts of law, he is now languishing in jail. “Its about time that our Supreme Court steps in into this issue to bring back respect for law and order by our police and government officials, for the orderly administration of justice.” Lee added.

“The Php6.6 Billion being flaunted by HDMF in the media is not a loan of Globe Asiatique from HDMF”, Lee insisted.

Lee emphasized that even in the recent Senate hearing conducted by the Committee on Urban Planning Lawyer Darlene Berberabe, President of HDMF-Pag Ibig Fund admits that the Php6.6 Billion is an end-users loan which means that it is the totality of the obligations of the PAG-IBIG members who bought the houses and lots at the Xevera projects of Globe Asiatique.

“This is precisely the reason why up to now, HDMF has not even sent us any demand letter for the alleged Php6.6 Billion claim. There is no pending case filed by HDMF against Globe Asiatique to claim this Php6.6 Billion.

As a matter of fact, the counterclaim of HDMF in Civil Case No. 10-1120 which we filed against it for breach of contract is only Php12 Million which accounts for attorney’s fees and cost of litigation,” Lee emphasized.
